If Estate is not probated in the state where the property is located, an original Affidavit of Death and Heirship form, completed, signed and notarized will need to be provided (Download PDF)
**Please note that distribution of the deceased’s interest is governed by the laws of the state where the mineral interest is located. If probate proceedings are held in a state other than where the mineral interest is located, it will not be effective to transfer title of the mineral interests. Once the Estate is closed, we will require an Affidavit of Death and Heirship to determine the heirs under the laws of the governing state(s). If there is a difference in the persons or entities to inherit under the probated Estate and the persons to inherit under intestate succession (without a will) laws of the state where the mineral interest is located, further requirements will be necessary.
